Enforcement of Smoke-Free Area (KTR) Policies by Regional Governments from the Perspective of Protecting the Right to Health

This research focuses on the implementation of Smoke-Free Area (SFA) policies by local governments in Indonesia, particularly in relation to the fulfillment and protection of the right to health. Using a normative legal research design, this study utilizes legal and conceptual approaches to examine constitutional norms, sectoral health legislation, and regional regulatory instruments governing smoke-free environments. The analysis shows that, at the normative level, the applicable legal framework has provided adequate authority to local governments to designate smoke-free areas, carry out oversight functions, and impose administrative sanctions. However, practical enforcement of these policies remains suboptimal, hampered by inadequate oversight systems, institutional constraints, inconsistent application of administrative sanctions, and varying levels of public awareness and legal compliance. Consequently, the regulatory objective of the SFA policy to ensure effective public health protection has not been fully realized. This study emphasizes the need to strengthen law enforcement mechanisms, enhance coordination between relevant institutions, and ensure consistent application of administrative sanctions to enhance the effectiveness of the policy. From a legal perspective, this article contributes to the discourse on administrative and health law by explaining the role of local government authorities in protecting collective health rights and by proposing legally grounded recommendations to improve the formulation and enforcement of regulations at the regional level.
